End User License Agreement
This End User License Agreement ("EULA") governs your limited license to access and use the randum.org website, and any current or future companion application, API, or software Randum makes available (together, the "Software"). It works alongside, and does not replace, the Terms of Service, which governs marketplace conduct, Jobs, payments, and disputes between users. If the two documents conflict on a licensing question, this EULA controls; on a marketplace-conduct question, the Terms of Service controls.
1. License Grant
Subject to your compliance with this EULA and the Terms of Service, Randum grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Software for your own personal or internal business use.
2. License Restrictions
You may not, and may not permit anyone else to:
- Copy, modify, or create derivative works of the Software;
- Reverse engineer, decompile, or disassemble the Software, except to the extent applicable law expressly permits despite this restriction;
- Rent, lease, sell, sublicense, or otherwise transfer rights in the Software;
- Remove or obscure any proprietary notice on the Software;
- Scrape, crawl, or use automated means to access the Service, or circumvent any rate limit, security control, or access restriction, except a publicly documented API provided for that purpose;
- Use the Software to build a competing product or service.
3. Ownership
The Software, including all source code, design, and trademarks (including "Randum" and associated logos), is owned by Randum and is protected by intellectual property laws. This EULA grants you a license to use the Software — it does not sell or transfer any ownership right.
4. Feedback
If you send Randum feedback, suggestions, or ideas about the Service, you grant Randum an unrestricted, royalty-free, perpetual license to use them for any purpose, with no obligation to compensate or credit you.
5. Updates
Randum may update, modify, or discontinue any part of the Software at any time, with or without notice. Continued use after an update constitutes acceptance of the updated Software.
6. Third-Party Components
The Software may include or interoperate with third-party or open-source components, which remain subject to their own license terms. Nothing here restricts rights you separately hold under an open-source license to any such component.
7. No Warranty
The Software is provided "as is," without warranty of any kind, express or implied, to the maximum extent permitted by applicable law.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Randum's total liability arising out of this EULA will not exceed one hundred U.S. dollars ($100), and Randum is not liable for indirect, incidental, special, or consequential damages. This section does not limit liability that cannot be limited under applicable law.
9. Termination
This license terminates automatically if you breach this EULA or the Terms of Service, or if Randum discontinues the Software. Upon termination, you must stop using the Software. Sections 2, 3, 4, 7, 8, and 10 survive termination.
10. Governing Law
[Placeholder — confirm against the entity's actual state of formation/operation.] This EULA is governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
11. Entire Agreement
This EULA, together with the Terms of Service, is the entire agreement between you and Randum regarding your license to use the Software, and supersedes any prior agreement on that subject.
