Terms of Service

These Terms of Service ("Terms") govern access to and use of randum.org and its related services (the "Service"), operated by [Timothy Adams, sole proprietor, d/b/a Randum / Randum LLC — confirm entity status] ("Randum," "we," "us"). By creating an account or using the Service, you agree to these Terms and to our End User License Agreement. If you do not agree, do not use the Service.

1. What Randum Is

Randum is an online listing and matching platform where one user (a "Poster") can post a task ("Job") that another user (a "Doer") may claim or bid on. Users may also form or join a "Group" to bid and complete Jobs together, and eligible Doers may publish a service listing ("Advert").

Randum does not employ, supervise, background-check, insure, bond, or guarantee the work of any Poster, Doer, or Group. Randum is not a party to any agreement between a Poster and a Doer and is not responsible for the quality, legality, timeliness, or outcome of any Job.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is not directed to, and Randum does not knowingly collect information from, anyone under 18.

4. Payments

Randum does not process, hold, escrow, or transmit any payment between users. Randum is not a money transmitter, payment processor, or escrow agent.

The pay amount shown on a Job listing, and any bid submitted against it, reflects an amount proposed between the Poster and Doer only. Posters and Doers are solely responsible for agreeing on, and directly exchanging, payment by whatever lawful means they choose. Randum has no visibility into, and assumes no responsibility for, whether payment is made, made in full, or made on time.

5. Tiers, Ratings & Groups

Randum operates a reputation system ("Tier") based on the number of Jobs completed and star ratings ("Ratings") left by other users. A user's or Group's Tier determines the maximum pay amount they may claim or bid on.

6. Prohibited Content & Conduct

You may not post, request, offer to perform, or use the Service to facilitate any Job or Advert that is illegal, dangerous, or intended to harass, defraud, sexually exploit, or endanger any person, including (without limitation):

Randum may remove any Job, Advert, message, or account, and may report conduct to law enforcement, at its sole discretion, without prior notice.

7. In-Person Meetings & Physical Tasks

Many Jobs involve meeting another user in person or performing physical tasks. Randum does not participate in, supervise, or guarantee the safety of any such meeting or task.

You are solely responsible for evaluating and protecting your own safety when interacting with other users, including deciding whether, where, and how to meet. Randum recommends meeting in public places when practical, telling someone else your plans, and using independent judgment before agreeing to any Job — but these are suggestions, not safeguards Randum provides or verifies.

8. Assumption of Risk

You expressly assume all risk arising from your use of the Service and your interactions with other users, including but not limited to risk of personal injury, property damage, theft, non-payment, a Job not being completed or completed poorly, and any dispute between a Poster and a Doer. Randum does not control and is not responsible for the conduct, whether online or offline, of any user.

9. Release & Limitation of Liability

To the maximum extent permitted by applicable law, you release Randum, its owner(s), and its personnel from any claim, demand, or damages arising out of a dispute with, or harm caused by, another user or a Job. Nothing in this section releases Randum from liability that cannot be waived under applicable law.

To the maximum extent permitted by applicable law, Randum's total liability for any claim arising out of the Service will not exceed one hundred U.S. dollars ($100). Randum is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill.

10. Indemnification

You agree to indemnify and hold Randum harmless from any claim, liability, damage, or expense (including reasonable attorneys' fees) arising from your use of the Service, your Job postings or Advert content, your interactions with other users, or your violation of these Terms.

12. Intellectual Property

Randum owns the Service, including its software, design, and trademarks. You retain ownership of content you post (Job descriptions, pitches, messages, Advert text), but grant Randum a worldwide, royalty-free license to host, display, and distribute that content as needed to operate the Service.

13. Copyright (DMCA) Notices

If you believe content on the Service infringes your copyright, send a notice meeting the requirements of 17 U.S.C. §512(c)(3) to [DMCA agent email/address].

14. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Randum does not warrant the Service will be uninterrupted, secure, or error-free.

15. Termination

You may stop using the Service at any time. Randum may suspend or terminate your access at any time, with or without cause or notice. Sections 4, 8, 9, 10, 11, 12, and 16 survive termination.

16. Governing Law
